2. Description of the Service

CarbonFirefly provides tools to estimate the carbon footprint of AI usage, including:

• A web-based carbon calculator for AI model queries
• A browser extension that monitors AI platform usage and estimates carbon emissions
• A personal dashboard to track and manage your AI carbon footprint
• A "Try It Live" feature that executes real AI queries for carbon comparison

3. Carbon Estimates — Important Disclaimer

The carbon emission figures provided by CarbonFirefly are estimates only. They are based on publicly available data, academic research, and heuristic modelling. They are not certified measurements.

Carbon estimates are subject to uncertainty ranges (typically ±30–55% depending on the modality). CarbonFirefly makes no guarantee as to the accuracy, completeness, or reliability of any carbon estimate. You should not rely on these estimates for regulatory reporting, carbon offsetting claims, or any purpose requiring certified carbon accounting.

4. User Accounts

Certain features of the Service (such as the personal dashboard and "Try It Live") require you to create an account. When you create an account, you agree to:

• Provide accurate and complete information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activity that occurs under your account

You must be at least 13 years old to create an account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to the Service, other users' accounts, or our systems
• Reverse engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or use automated tools to extract data from the Service without permission
• Interfere with or disrupt the integrity or performance of the Service
• Use the "Try It Live" feature to generate harmful, abusive, or illegal content
• Resell or redistribute the Service without our written consent

6. Browser Extension

The CarbonFirefly browser extension monitors your interactions with supported AI platforms (such as ChatGPT, Claude, and Gemini) to estimate carbon emissions. The extension:

• Does not read, store, or transmit your prompts or AI response content
• Only collects metadata necessary for carbon estimation (token counts, model identifiers, timestamps)
• Operates in accordance with our Privacy Policy

The extension requires certain browser permissions to function. These are described in our Privacy Policy. You can uninstall the extension at any time.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by CarbonFirefly Ltd and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You retain ownership of any data you input into the Service. By using the Service, you grant us a licence to process your data as necessary to provide the Service, in accordance with our Privacy Policy.

8. Third-Party Services

CarbonFirefly integrates with or references third-party AI platforms (OpenAI, Anthropic, Google, and others). We are not affiliated with, endorsed by, or responsible for these platforms. Your use of third-party services is governed by their respective terms and policies.

The "Try It Live" feature sends your prompt to third-party AI providers on your behalf. By using this feature, you acknowledge that your prompt text will be processed by the selected AI provider in accordance with their terms of service.

9. Service Availability

We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. We may suspend or discontinue the Service (or any part of it) at any time for maintenance, updates, or other reasons, with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied
• CarbonFirefly Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you have paid us (if any) in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. You may request export or deletion of your data in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also be entitled to bring a claim in your local courts under mandatory consumer protection laws.
